Ballys Atlantic City Sues Whittaker

Operators of another Atlantic City casino, now the second to file a compaint, have sued Powerball winner Jack Whittaker for writing checks from a bank in West Virginia that is already closed.

Lawyers for Bally's Park Place Inc., known as Bally's Atlantic City, filed the lawsuit June 13 in U.S. District Court in Newark, N.J. Whittaker is already being sued by Boardwalk Regency Corp., the parent company of Caesars Atlantic City.

The casinos accuse Whittaker of issuing bad checks to cover credit lines at the casinos.

The Bally's allegations originate from the three checks that he wrote to the casino in July of 2004. Whittaker wrote three checks on July 30 and 31 in 2004 according to the lawsuit. City National Bank in Charleston reportedly returned the two $20,000 checks and a $60,000 check, saying that the bank of origin is closed.

Bally's officials have demanded repayment from Whittaker to no avail, according to the lawsuit. U.S. District Judge Jerome B. Simandle meanwhile has referred the case for arbitration.

Whittaker also wrote 21 checks to Caesars amounting to a stagerring $1.5 million, as stated in the lawsuit. All 21 checks were returned, and Whittaker has likewise refused repayment when asked by the casino.
